Terms and Conditions

These Terms and Conditions ("Terms") govern your access to and use of the Parklo mobile application and related services (the "Service"). By creating an account or using Parklo, you agree to these Terms and our Privacy Policy.

1. Eligibility

You must be at least 18 years old and legally able to enter a binding agreement. You must hold a valid driving license and vehicle registration where required by local law. You are responsible for ensuring your use of Parklo complies with traffic, parking, and municipal regulations in your emirate or jurisdiction.

2. The Service

Parklo is a community platform that helps drivers coordinate parking spot swaps, share vacant spot availability, and navigate to matched locations. Parklo does not own parking spaces, operate paid parking facilities, or guarantee that a spot will be available, legal, or suitable for your vehicle.

3. Account Registration

You agree to provide accurate registration information, keep your credentials confidential, and notify us of unauthorized access. You are responsible for all activity under your account.

4. Acceptable Use

You agree not to:

• provide false vehicle, plate, or location information;
• misuse swap requests, rewards, or wallet credits;
• harass, threaten, or endanger other users;
• attempt to reverse engineer, scrape, or disrupt the Service;
• use the Service for unlawful parking, trespassing, or evading fees;
• create multiple accounts to abuse promotions or rewards.

We may suspend or terminate accounts that violate these Terms.

5. Location, Maps, and Safety

Real-time location features are provided for convenience only. You must obey road laws, avoid using the app while driving when prohibited by law, and verify parking rules before leaving or occupying a spot. You assume all risk related to parking decisions, traffic, vehicle damage, fines, and personal safety.

6. Swaps, Vacant Offers, and PKT Wallet

Swap matching, reservation fees, provider rewards, and PKT balances are governed by in-app rules and server-side logic. Amounts may change with notice. PKT has no cash value unless explicitly stated in a promotion. We may adjust balances to correct errors, fraud, or dispute outcomes. Completed swaps are based on mutual confirmation by participants.

7. Bluetooth and Automation Features

Optional Bluetooth-based departure detection is an assistive feature only. It may produce false positives or miss events. You remain responsible for confirming when you vacate a spot and for accurate status updates.

8. Disputes Between Users

If you report another user, our team may review swap records, messages, and account data. Our resolution decisions are made in good faith but do not create a duty of care beyond providing the platform. Serious incidents should also be reported to local authorities where appropriate.

9. Fees and Payments

Some features may involve reservation fees or future paid services. Any applicable fees will be shown before you confirm an action. All fees are non-refundable except where required by law or explicitly stated in a dispute resolution.

10. Intellectual Property

Parklo, its logo, software, and content are owned by us or our licensors. You receive a limited, non-exclusive, revocable license to use the app for personal, non-commercial purposes.

11. Third-Party Services

The Service integrates third-party providers including Firebase, Google Maps, and device platform services. Your use of those services may be subject to their terms.

12. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PARKLO AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND PARTNERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, VEHICLE DAMAGE, PARKING FINES, OR PERSONAL INJURY ARISING FROM YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE IS LIMITED TO THE GREATER OF (A) THE FEES YOU PAID TO PARKLO IN THE 12 MONTHS BEFORE THE CLAIM OR (B) AED 100.

14. Indemnity

You agree to indemnify and hold harmless Parklo from claims arising out of your use of the Service, your parking conduct, your content, or your violation of these Terms or applicable law.

15. Suspension and Termination

You may delete your account at any time through the app. We may suspend or terminate access for violations, risk to other users, or operational reasons. Provisions that by nature should survive termination will survive.

16. Changes to These Terms

We may modify these Terms. If we make material changes, we will provide notice in the app or by email. Continued use after the effective date constitutes acceptance.

17. Governing Law

These Terms are governed by the laws of the United Arab Emirates. Courts in the UAE shall have exclusive jurisdiction, without prejudice to mandatory consumer protections in your jurisdiction.
